The Seller reserves the right to update or modify this Agreement at any time without prior notice. It is the Buyer's responsibility to review this Agreement periodically for changes. Continued use of the website and purchase of products after any modifications shall constitute the Buyer's consent to such changes.

**Gift Cards:**

This E-Gift Card is non-refundable and cannot be exchanged for cash or any other forms of payment. (See Cooling Off section below)

The E-Gift Card is valid for a period of 12 months from the date of purchase.

To redeem, visit our website and enter the unique code at checkout.

Any unused balance after the expiry date will not be refunded or credited.

Lost or stolen cards cannot be replaced or refunded, so please treat it like cash.

The E-Gift Card is for personal use only and may not be resold.

Altitude Clothing Group LTD (the owner of this brand) reserves the right to amend these terms and conditions at any time.

At the time of writing (18/01/2024), there isn't a specific federal law that sets a minimum expiry date for gift cards in the UK. However, businesses need to comply with consumer protection regulations, and the terms and conditions of gift cards should be fair and transparent.  In the UK, these T&Cs constitute legally binding contracts governing the purchase, distribution, and/or facilitation of gift cards.

Fairness and Transparency: The terms and conditions of gift cards must be clear, easily accessible, and fair. Consumers should be informed about any expiry dates or conditions associated with the gift card.

We address this by having this laid out in terms and conditions and summarized on the gift​ card purchasing page and being available to answer any questions in regard to the purchase and usage of gift cards.

 

Unfair Terms: Unfair terms in consumer contracts are prohibited. Terms that create a significant imbalance between the rights of the business and the consumer to the detriment of the consumer may be considered unfair.

 

Our terms are in line with the industry standards​

Expiration Periods: While there isn't a specific minimum expiration period set by law, excessively short expiry dates or terms that are not reasonable might be subject to scrutiny.

Our limit is set to 12 months from the date of purchase.

**Cooling off period**

Although not required by law, currently in the UK, we will offer a 14 day cooling off period as we feel it is fair for our customers and we understand what it can be like to change your mind after a purchase. This is covered by the below:

Right to Cancel: The regulations give consumers the right to cancel a distance or off-premises contract within 14 days of receiving the goods or entering into the contract (there are exceptions, such as for personalized items).

Gift cards can only be refunded under the cooling off period if the full amount has been unused. Usage of the gift card will void the cooling off period.

**Governing Law:**
This Agreement is governed by and shall be construed in accordance with the laws of Scotland and the broader legal framework of the United Kingdom. Any disputes arising from this Agreement shall be resolved through amicable negotiation. If resolution cannot be reached, the parties agree to submit to the exclusive jurisdiction of the courts in Scotland.
